ADULT PARTICIPATION AGREEMENT & RELEASE OF LIABILITY

IMPORTANT: PLEASE READ CAREFULLY

By signing this agreement, you acknowledge that you are giving up certain legal rights, including the right to sue.

1. ASSUMPTION OF RISK

I understand that participation in Brazilian Jiu Jitsu and martial arts activities involves inherent risks, including but not limited to:

• Falls, takedowns, and physical impact
• Joint locks and submission techniques
• Chokes and restricted breathing
• Physical contact with instructors and training partners
• Risk of injury including sprains, fractures, dislocations, paralysis, or death

I understand that these risks may arise from my own actions, the actions of others, or the condition of the training environment. I freely and voluntarily accept and assume all such risks.

2. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

In consideration of being permitted to participate, I agree to release and discharge Tera Brazilian Jiu Jitsu Academy, its directors, instructors, coaches, staff, students, guests, and landlord from any and all claims, demands, damages, or causes of action arising from any injury, illness, or loss I may sustain.

This release includes any claims arising from the negligence of the released parties, to the fullest extent permitted by law.

3. INDEMNIFICATION

I agree to indemnify and hold harmless Tera Brazilian Jiu Jitsu Academy and all associated parties from any claims, damages, costs, or legal expenses (including lawyer fees) arising from my participation or from any claim brought on my behalf that contradicts this agreement.

4. PHYSICAL CONTACT & NATURE OF TRAINING

I understand that Brazilian Jiu Jitsu is a full-contact martial art. I acknowledge that physical contact may include incidental or intentional contact with any part of the body, including the chest, buttocks, groin, or other sensitive areas as part of legitimate training.

I also understand that instructors may physically adjust or manipulate my body to assist in learning techniques.

5. FITNESS TO PARTICIPATE

I confirm that I am physically fit to participate and have not been advised otherwise by a medical professional. I agree to disclose any injuries, medical conditions, or limitations that may affect my ability to safely participate.

I agree to stop training immediately if I feel pain, discomfort, or believe continuing may result in injury.

6. VOLUNTARY PARTICIPATION

I understand that my participation is voluntary and that I may withdraw from any activity at any time.

7. CONDUCT & SAFETY

I agree to follow all gym rules and instructor guidance. I understand that unsafe or disruptive behavior may result in removal from training without refund.

8. COMMUNICABLE ILLNESS

I understand that participation may expose me to illness, including but not limited to skin infections (e.g., staph, ringworm) and other communicable diseases. I agree not to attend if I am ill or experiencing symptoms of illness.

9. PERSONAL PROPERTY

I understand that Tera Brazilian Jiu Jitsu Academy is not responsible for lost, stolen, or damaged personal property.

10. MEDIA RELEASE

I consent to the use of my image, likeness, audio, and video recordings for promotional and marketing purposes without compensation.

11. SEVERABILITY

If any portion of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. ACKNOWLEDGEMENT

I confirm that:

• I have read and understood this agreement in full
• I understand that I am giving up substantial legal rights, including the right to sue
• I am signing this agreement freely and voluntarily

13. PAYMENT AND REFUND POLICY

I understand and agree that all membership fees, class fees, and other payments made to Tera Brazilian Jiu Jitsu Academy are non-refundable, except where required by law or otherwise explicitly stated in writing by the Academy.

I acknowledge that:

• Memberships, punch passes, and drop-in fees are non-refundable
• Missed classes do not entitle me to refunds or credits
• Cancellation of membership does not entitle me to reimbursement for prior payments
• Any exceptions are at the sole discretion of Tera Brazilian Jiu Jitsu Academy

By signing this agreement, I acknowledge that I have reviewed and agree to the Academy’s membership and billing policies.

YOUTH PARTICIPATION AGREEMENT (PARENT/GUARDIAN)

IMPORTANT: PLEASE READ CAREFULLY

By signing this agreement, you acknowledge that you are giving up certain legal rights on behalf of your child, including the right to sue.

1. ASSUMPTION OF RISK

I understand that my child’s participation in Brazilian Jiu Jitsu and martial arts activities involves inherent risks, including but not limited to:

• Falls, takedowns, and physical impact
• Joint locks and submission techniques
• Chokes and restricted breathing
• Physical contact with instructors and other participants
• Risk of injury, including serious injury or death

I accept and assume all such risks on behalf of my child.

2. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

I agree, on behalf of my child and myself, to release and discharge Tera Brazilian Jiu Jitsu Academy, its directors, instructors, coaches, staff, students, guests, and landlord from any and all claims arising from injury, illness, or loss sustained during participation.

This includes claims arising from the negligence of the released parties, to the fullest extent permitted by law.

3. INDEMNIFICATION

I agree to indemnify and hold harmless Tera Brazilian Jiu Jitsu Academy from any claims brought on behalf of my child that contradict this agreement.

4. PHYSICAL CONTACT

I understand that my child will be participating in a full-contact activity, which may involve contact with all areas of the body as part of legitimate training.

5. FITNESS & RESPONSIBILITY

I confirm that my child is physically fit to participate and will not attend if ill or injured. I agree to inform instructors of any relevant medical conditions.

6. CONDUCT & SAFETY

I understand that unsafe or disruptive behaviour may result in removal from class.

7. COMMUNICABLE ILLNESS

I acknowledge the risk of illness and agree not to bring my child to class if they are ill.

8. MEDIA RELEASE

I consent to the use of my child’s image, likeness, audio, and video recordings for promotional purposes without compensation.

9. SEVERABILITY

If any portion of this agreement is found unenforceable, the remainder remains valid.

10. ACKNOWLEDGEMENT

I confirm that:

• I am the parent or legal guardian
• I have read and understood this agreement
• I am signing voluntarily on behalf of my child

11. PAYMENT AND REFUND POLICY

I understand and agree that all membership fees, class fees, and other payments made to Tera Brazilian Jiu Jitsu Academy are non-refundable, except where required by law or otherwise explicitly stated in writing by the Academy.
